Terms & Conditions

Chilli Talk is a brand of Vectone Services Ltd, a company registered in England and Wales with its registered address at 58 Marsh Wall, London E14 9TP. By purchasing Chilli Talk products and / or services and using them you agree to be bound by the following terms and conditions, together the e-commerce terms set out below, effective from August 2008 and which apply to the use of Chilli Talk products and / or services only.

Calls will be charged on a per minute basis rounded up to the next full minute. To access the Chillitalk’s toll free number (0800) a surcharge of 10 pence will be charged from national fixed line and mobile, and 15 pence will be charged from a payphone in U.K. A connection charge of 10 pence applies to all calls. A maintenance charge may apply: call Customer service for details. Chillitalk may disallow calls to some premium rate, geographic or non-geographic, international and toll free numbers. Chillitalk recommends that customers check the relevant charges with their mobile provider before using this product. Chillitalk aims to provide best call quality and no disruptions. However the calls may get disconnected in case of insufficient balance required for a destination, and any other reason beyond our control.

Calls between Vectone World to Vectone World is free, Chillitalk to Vectone World bears a connection charge of £0.10 per call and Calls to Vectone World from Chillitalk from 0800 access numbers are subject to an additional surcharge of 1p/min. These charges exclude any charges you are required to pay by a third party.

We may disallow calls to some premium rate, geographic or non-geographic, international and toll free numbers. Your service provider may charge you for using access numbers, such as 020 and 0800; we recommend you check this with your service provider before using this product. As matter of policy we will not deliberately disconnect calls less than provided that there is sufficient credit for the call. Disconnection may occur for reasons beyond Vectone's control.

We may suspend provision of the services in the event of non-payment by wholesalers, retailers and / or distributors of Chillitalk. In the event that we are forced to do so you should approach the seller from whom you purchased the goods and / or services. Save whereby provided for by statute we do not refund purchases made, where you purchase Chillitalk products and / or services online. These will be delivered to you electronically.

 We reserve the right to inform you by telephone or any other means of communication of any telecommunication products, services or offers related to this product, from us or an affiliated company. Should you do not wish to receive offers or further product information please send an email stating your name and mobile / phone number to unsubscribe@vectone.com or call customer services on 020 7179 2144.

1 Definitions

1.1 "Customer" means the individual who buys Goods from Vectone and that has a UK billing address for the payment card with which they purchase the goods;
1.2 "Contract" means the contract between Vectone and the Customer for the sale and purchase of Goods incorporating both these terms and conditions and those terms and conditions relating to Chilli Talk available on the Website;
1.3 "Goods" means the goods that the Customer agrees to buy from Vectone and which goods give access to the Vectone Services;
1.4 "Vectone" means Vectone Services Limited, a company incorporated in England having its registered office at 54 Marsh Wall, London, E14 9TP
1.5 "Vectone Services" means telephony services provided to end-users by Vectone, one of its subsidiaries or affiliates
1.6 "Website" means the website at www.Chilli Talk.com

 

2 Ordering and delivery of Goods

2.1 Customer accepts that the placing of any order shall be deemed as making an offer to purchase which is subject to acceptance by Vectone and which may be rejected for any reason. Vectone shall not be bound to supply the Goods unless it has confirmed acceptance of an order by any method it deems appropriate including by the delivery of the Goods.
2.2 Where the Goods ordered by the Customer are not available the Customer will be informed and may either wait until the Goods are available, cancel the order and receive a full refund or receive an alternative product of the same face value.
2.3 Goods purchased through the Website are delivered electronically to the email address that you provide.
2.4 Goods supplied will normally be delivered within 24 hours of receipt of payment.
2.5 Title and risk in the Goods shall pass to the Customer upon delivery of the Goods to the email address provided by the Customer when making a purchase.

 

3 Price and payment for Goods

3.1 The Price of the Goods shall be that stipulated on Vectone's Website. The Price is inclusive of VAT.
3.2 The total purchase price, including VAT, will be displayed on the website prior to confirming and paying for the order.
3.3 Payment of the Price plus any applicable charges must be made in full before the Goods are delivered. Payment is to be made by any of the credit or debit cards accepted by Vectone, details of which are stated on the Website. All orders are subject to authorisation of payment by the relevant card issuer prior to despatch of the Goods.

 

4 Rights of Vectone

4.1 Vectone reserves the right to adjust any product or price on the Website at any time.
4.2 Vectone reserves the right to withdraw any Goods from sale even if listed on the Website at any time.
4.3 Vectone shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to accept an order.

5 Warranties

5.1 Except where the Customer is dealing as a consumer, all other warranties, conditions, or terms relating to fitness for purpose, merchantability or condition of the Goods, whether implied by statute, common law or otherwise are excluded. Any recommendation or suggestion relating to any of the Goods and made by Vectone is given in good faith, but it is for the Customer to satisfy himself as to the suitability of the Goods for the Customer's purposes.
5.2 The Goods will be delivered online. In such circumstances, Vectone will not be liable for any temporary unavailability of such Goods due to any failure of the Website, any telecommunications system and / or the world wide web, including any downtime of the Website or telecommunications systems to planned or emergency maintenance.
5.3 Vectone bears no liability for non-delivery where the address you have entered on the website is incorrect or the email address fails for some reason.

6 Cancellations / Returns

6.1 If the Goods are defective, Customer must inform Vectone within 7 days. If the Customer fails to do so the Customer shall be deemed to have accepted the Goods.
6.2 Where a claim of defect or damage is made the Goods shall be deactivated by Vectone. If on inspection / investigation by Vectone the goods are found to be defective, the Customer shall be entitled to provision of replacement Goods by Vectone of the same type and denomination.
6.3 If you are a Customer, in addition to the rights set out herein, you have statutory rights under the Customer Protection (Distance Selling) Regulations 2000 as follows:
6.3.1 Under the Distance Selling Regulations (2000) in the United Kingdom, Customer, if a UK resident, has the right to cancel the agreement until the end of the 7th working day after the date on which the contract was formed.
6.3.2 Where Customer uses the Vectone services before your right to cancel expires Customer loses the right to cancel the contract.
6.3.3 Where Customer chooses not to use the goods or use the Vectone Services until after the end of Customer's right to cancel Vectone will not provide the goods or use of the Vectone Services until after Customer's right to cancel expires.
6.3.4 Where Customer has the right to cancel and wants to cancel the contract Customer must write to Vectone, ensuring that Customer's letter reaches Vectone before the expiry of Customer's right to cancel, to tell Vectone that Customer wants to cancel the contract.
6.3.5 Where Customer has the right to cancel and gives Vectone notice that Customer wants to cancel Vectone agrees to return any payment made by Customer within 30 days of the date on which Vectone receives Customer's notice.

7 Limitation of Liability

7.1 Except as may be implied by law where the Customer is dealing as a Customer, in the event of any breach of these terms and conditions by Vectone the remedies of the Customer shall be limited to damages which shall in no circumstances exceed the Price of the Goods paid for and Vectone shall never be liable for any indirect, incidental or consequential loss or damage whatever suffered by the Customer. 7.2 Nothing in these terms and conditions shall exclude or limit the liability of Vectone for death or personal injury resulting from the negligence of Vectone or that of Vectone's agents or employees.

8. Amendments and waiver

These terms and conditions may be amended by Vectone at any time. No provision of these terms and conditions and no right or obligation of either party under this terms and conditions may be waived except by an instrument in writing signed by the party waiving the provision right or obligation.

9. Severability

A finding that a term of these terms and conditions, is or has become, invalid, illegal or unenforceable in any respect under governing law it shall not affect or impair the validity, legality or enforceability of any other terms of these terms and conditions so long as the purpose of these terms and conditions are still capable of performance.

10. Jurisdiction

Any dispute relating to the validity, interpretation or execution of these terms and conditions shall be settled according to the Laws of England and the parties submit to the non-exclusive jurisdiction of the English courts.
